Proposal background

At the 29 April 2025 meeting, Council received a petition from 65 signatories seeking Council to implement a range of measures to stop alcohol and parties at Holloway Beach, Brighton. Concerns raised included the beach being known (to some community members), as a summer venue for rave parties (involving substantial quantities of alcohol, illicit drugs, generators, and amplified music), resulting in broken glass, sharp instruments, and refuse left on the beach and surrounding areas, posing an active risk for beach users and surrounding residents.

The issue of raves and large parties that do not have a permit has been raised with Victoria Police since early Summer 2024. The feedback from Victoria Police is that this location has not been a historically significant area of concern for them and as such they would not advocate for any change to Local Laws based on information at hand.

As supported at the 20 May 2025 meeting, and in line with Section 58 of the Local Laws Guidelines, we’re engaging with the community between 3 June – July 1 2025 to understand community sentiment about the proposed permanent ban of alcohol consumption and alcohol possession in unsealed containers (at all times, on any day), at Holloway Beach in Brighton, in accordance with Council’s Neighbourhood Amenity Local Law 2021 (the Local Law).

  • Current Local Law provisions

    • Requirement for a permit to hold an event within a municipal reserve (including the foreshore).
    • Prohibited use of amplifiers, musical equipment, public address systems and sound broadcasting equipment (other than as part of an approved permitted use) that may interfere with the use and enjoyment of any other person in the municipal reserve.
    • No alcohol consumption (in any municipal reserve) between sunset and sunrise.
  • Current response to unathorised events

    • Local Laws Officers rely on the Local Laws impounding provisions and powers to impound items (such as speakers and generators) as an effective tool to stop an unpermitted event.
    • Victoria Police are authorised to enforce Council’s Local Laws along with Local Law Officers.
    • The physical environment is challenging and can pose an Occupational Health and Safety issue for Council staff without early intervention and Police support.
  • Key considerations about the alcohol ban proposal

    Social: Providing safe access to open spaces like beaches benefits community wellbeing and fosters social connections.

    Natural environment: Parties and anti-social behaviour can harm community health and the foreshore environment.

    Built environment: Illegal activities damage Council assets, leading to higher maintenance and repair costs.

    Legal: Council can enforce liquor bans at municipal reserves as per Local Law Guidelines.
