What you told us
Participant feedback in Stage 1 consultation highlighted areas where the Local Law could be improved by removing or reworking some provisions. These clauses were seen as difficult to understand, difficult to enforce, unnecessarily burdensome or better regulated elsewhere.
Removing of the model aircraft/drone clause was most explicit given it duplicates Commonwealth aviation regulation. It is also important to provideflexibility for minor vehicle repairs such as changing a tyre.
Our proposed response
We’re proposing to delete the clauses that govern audible intruder alarms, feeding birds, vehicle repairs and model aircraft so that our Local Law focuses on practical, proportionate and enforceable matters, and to avoid provisions that create confusion or inconsistent compliance outcomes.
Proposed clauses to be deleted include:
15. Removing waste without authority
The clause is considered impractical to enforce and may create difficulties in achieving consistent compliance outcomes.
17. Fire hazards
New Dangerous Land clause has been written to cover dangerous situations broadly and addresses the keeping of land in a manner which is dangerous or likely to cause danger to health, life or property.Includes provision for hazardous substances
19. Audible intruder alarms
The clause is considered impractical to enforce and may create difficulties in achieving consistent compliance outcomes.
29. Feeding of birds on private property
The clause is considered impractical to enforce and may create difficulties in achieving consistent compliance outcomes.
32. Repair of vehicles is prohibited
The clause is considered impractical to enforce and may create difficulties in achieving consistent compliance outcomes.
65. Operation of model aircraft
The operation and use of model aircraft is regulated by the Civil Aviation Safety Authority (CASA).
74. Feeding of birds on public land
