Smoking and alcohol
What you told us
Feedback on activity centres and public spaces demonstrated that residents want public areas to be safe, accessible and comfortable. While smoking and alcohol were not reoccurring consultation themes, specific comments identified smoking in outdoor trading or pedestrian areas as an amenity issue.
Our proposed response
The proposed amendments respond to community feedback by updating the definition of tobacco products and giving Authorised Officers clearer power to direct a person to extinguish and dispose of a tobacco product in smoke-free areas.
Clauses that relate to ‘Smoking and alcohol’ include (pages 26 - 27 in the draft Community Local Law 2026):
44. Smoking in a smoke-free area
45. Consumption and possession of liquor
Key themes for proposed amendments
- Including the ability for Authorised Officers to issue a direction to a person smoking to extinguish and dispose of tobacco product in smoke-free areas.
- Updating the definition of tobacco products and including vaping devices.
- Introducing times when a person cannot consume liquor. ‘Sunset to sunrise’ is ambiguous and evidentially difficult.
- 7pm and 7am Eastern Standard Time; or
- 8pm and 8am Eastern Daylight Saving Time
