North Point café – Council resolution

At the April Council meeting a report was presented to Council to discuss the proposal to redevelop North Point Café with a liquor license amendment.

Council resolved to support Option 1 to give landlord consent to apply for a planning permit to demolish and rebuild North Point Café with a liquor license amendment and as well as offering a 21 year lease.

An extract of the minutes has been detailed below:

That Council:

1. Provide Landlord Consent for the tenant to apply for a Planning Permit to rebuild the café subject to detailed design having been approved by the Director of Corporate Services.

2. Provide Landlord Consent for the tenant to apply for a Planning Permit to amend the liquor licence to a ‘Restaurant and Café Licence’ for the below hours:

Monday - Wednesday: 11:30am – 9:30pm

Thursday - Sunday: 11:30am – 11:00pm

Public Holiday: 11:30am – 11:00pm

Public Holiday Eve: 11:30am – 11:00pm.

3. In the event the tenant is unable to obtain a planning permit for the demolition, rebuild and/or amendment to the liquor licence, authorise officers to negotiate a refurbishment of the existing building with final approval being at the sole discretion of the Director of Corporate Services.

4. Authorise the Director of Corporate Services to commence the statutory procedures under Sections 190 and 223 of the Local Government Act 1989 to lease part of 2b North Road Brighton to the current tenant on the below terms: Term: 21 Years Base Rent: to be determined by Councils Valuer Turnover Rent: 7.5% of turnover that exceeds 12.5 times the base rent. Rent Escalation: C.P.I Melbourne All Groups.

5. In the event a submission is received, authorise the Director of Corporate Services to convene a Section 223 Special Committee of Council meeting on Wednesday 10 July 2019 commencing at 6.30pm at the Council Chambers, Boxshall Street Brighton to hear any submitters that wish to be heard.

6. In the event no submissions are received, authorise the Director of Corporate Services to execute the lease with the tenant on the terms set out in point 4.

PUBLIC NOTICE INVITING SUBMISSIONS UNDER SECTION 223

BAYSIDE CITY COUNCIL

PROPOSED UPGRADE OF NORTH POINT CAFÉ

2B NORTH ROAD BRIGHTON

Bayside City Council (“Council”), gives notice in accordance with Sections 190 and 223 of the Local Government Act 1989 (‘Act’), of its intention to enter into a Lease with Same Pty Ltd for the tenancy of the building at 2B North Road Brighton, known as North Point Cafe.

The proposed lease is for a total of 21 years, at a commencement base rental of more than $50,000 (plus GST), yet to be determined by Council’s Property Valuer and subject to annual increases in line with Consumer Price Index Melbourne All Groups (CPI). The permitted use of the premises is for a café / restaurant. Additional Turnover rent would be calculated at 7.5% of gross turnover that exceeds 12.5 times the base rent.

Any person wishing to make a submission to the Proposal must lodge their submission before 5:00pm Friday 21 June, 2019. Submissions may be delivered to the Council offices at 76 Royal Avenue Sandringham or addressed as follows

All submissions will be considered in accordance with Section 223 of the Act and, will be made publically available.

If a person wishes to be heard in support of their submission they must include the request to be heard in the written submission and this will entitle them to appear in person or by a person acting on their behalf, before a Special Committee of Council to be held on Wednesday, 10 July 2019 at 6:30pm in the Council Chambers, Boxshall Street, Brighton.
